- What is Family-Based Immigration?
Family-based immigration allows U.S. citizens and lawful permanent residents (Green Card holders) to sponsor close family members to live in the United States. This process can lead to permanent residency, and eventually, U.S. citizenship. The U.S. government recognizes the importance of family reunification and offers various visa options for this purpose.
There are two main categories in family-based immigration:
● Immediate Relative Visas: These are for close family members of U.S. citizens, such as spouses, children under 21, and parents. Immediate relatives have priority and are not subject to annual visa limits.
● Family Preference Visas: These are for more distant relatives, such as adult children, siblings, and spouses or children of lawful permanent residents. These visas are subject to annual caps, and wait times can vary depending on the category and country of origin.
- Who Can Be Sponsored?
● Immediate Relatives of U.S. Citizens
Immediate relatives of U.S. citizens(Spouses of U.S. citizens, Unmarried children under 21 of U.S. citizens, Parents of U.S. citizens (if the U.S. citizen is over 21)have the highest priority for family-based immigration. They do not have to wait in long queues for visa availability, as their petitions are processed more quickly.
● Other Family Members
Other family members may also be eligible for sponsorship, but they must wait for visa availability due to annual limits on certain categories. These include:
● Unmarried sons and daughters (21 or older) of U.S. citizens
● Spouses and unmarried children of permanent residents (Green Card holders)
● Married sons and daughters of U.S. citizens
● Siblings of U.S. citizens (if the U.S. citizen is over 21)
